SOLD - Bankruptcy Auction - Fleet of 78 Commercial Trucks and Trailers

Bankruptcy Auction – March 28, 2023 @ 1pm – $110,000 Opening Bid - On behalf of the Chapter 7 Trustee, RealMarkets is selling the fleet of 70+ commercial trucks and trailers owned by D.A. Foster Company.  The entire fleet is being sold for one bid.  We are not offering the assets individually.  The inventory of trucks includes Mack, Dodge, Ford and Chevrolet Trucks, including flatbed trucks, pick-up trucks, half ton and 3/4 ton pick up trucks.  The trailer inventory includes single and tandem axle equipment trailers by Big Tow, Carry On, Sterling, Butler, Hogg, Miller and Interstate.  Please refer to the inventory for complete details.  Please note that the marketing photographs may include assets not included in the sale.  Any assets that are not DMV-titled assets are not part of the sale, including any personal property or equipment located on or in any of the trucks or trailers.  We are only selling assets that are subject to a DMV title.  No “yellow iron”, such as bulldozers or excavators, are included in this sale.  The auction will be held via a Zoom hearing with the Bankruptcy Court. Inspections:

The assets will be available for inspection on Wednesday, March 15, 2023 from 10:00am – 1:00pm and Friday, March 24, 2023 from 10:00am – 1:00pm.  Do NOT visit the location of the assets at any other time.  

Terms of Sale:

This sale is subject to the approval of the US Bankruptcy Court, EDVA, Alexandria Division, Case No. 23-10151-KHK.  The $110,000 asking price is the opening bid.  No offers lower than the opening bid will be accepted.   The date and location of the auction to be determined by the Bankruptcy Court on March 14, 2023. No Buyers Premium.  Buyer is responsible for payment of all sales taxes.  Each bidder must register in advance with RealMarkets and pay a $22,000 deposit by Monday, March 27, 2023 @ 3:00pm EST.  All deposits shall either be in certified check or wire.

In addition to the Deposit requirement, each bidder must register with the US Bankruptcy Court. Please request to register for the hearing no later than Friday, March 24, 2023 in order to allow time for the Court to process your request to participate in the auction hearing. Registration for the hearing does not commit or approve you to bid. You must also pay the deposit as noted above.

Free and clear DMV titles to be provided to the winning bidder at closing, with the exception of one trailer that does not have an identifable VIN (Lot 116).  All trucks and trailers must be removed from the site by April 14, 2023.  Please refer to the MOTION FOR ENTRY OF AN ORDER (A) APPROVING AUCTION AND BIDDING PROCEDURES IN CONNECTION WITH THE SALE OF THE DEBTOR’S MOTOR VEHICLES FREE AND CLEAR OF LIENS, CLAIMS AND INTEREST PURSUANT TO 11 U.S.C. § 363(F); (B) SCHEDULING AUCTION AND SALE HEARING; AND (C) APPROVING THE SALE OF THE MOTOR VEHICLES TO THE SUCCESSFUL BIDDER FREE AND CLEAR OF LIENS, CLAIMS AND INTERESTS.
